LegalRail is a company established in The Hague (NL), with the purpose of practising the legal profession, in particular in the (broad) railway sector.
These General Terms and Conditions apply to all instructions, under whatever name, of the client to LegalRail.
The client will consider LegalRail alone as the contracted party. The following articles will not apply: Article 7:404 BW [Dutch Civil Code] (which provides an arrangement in the event that a specific person is asked to carry out the instruction) and Article 7:407 Paragraph 2 (which establishes several liability in the event that two or more persons carry out an instruction).
The liability of LegalRail will always be limited to the sum paid in an occurring case by virtue of the professional indemnity insurance effected by LegalRail, increased by the sum of the own risk which, according to the policy terms, is not payable by the insurer.
Any persons who are associated with LegalRail, directly or indirectly, and are involved in any manner in the services provided by or on behalf of LegalRaid can also appeal to these General Terms and Conditions.
The relationship between the client and LegalRail is governed by Dutch law.
The Court in The Hague alone is competent to take cognisance of any dispute between client and contracting party.
